NGT committee gives clean chit to My Home Constructions' project, Real Estate News, ET RealEstate
HYDERABAD: A joint inspection committee of the National Green Tribunal (NGT) has given a clean chit to a My Home Constructions’ apartment project. In a report filed with the NGT on Monday, the committee said there was no encroachment of three lakes by ‘My Home Avatar’ in Puppalguda of Gandipet mandal.

The committee submitted its report after a complaint was filed by Telangana Congress president and Malkajgiri member of parliament A Revanth Reddy alleging that My Home Constructions’ residential development project was encroaching into nearby water bodies.

“As per the topographic map, there is no water canal/channel passing through My Home Avatar project,” it said.

The committee also said an NOC from the irrigation department was mandatory only if a project site was bounded by any water body or notified water channels/ streams passing through the project site.

“In the present case, the NOC from the irrigation department may not be required,” it said.

In the report, the committee said: “As per the village revenue map of Puppalguda, there is no encroachment of Narsingi lake 2 and Mushkin Cheruvu by My Home Avatar project. There is also no connection between Mushkin Cheruvu and Nagireddy Kunta through any stream.”

The report further said as per a 2003 image from Google, an agricultural outlet channel from survey Nos. 272 and 273 feed the nearby agricultural fields.

However, in Google’s 2008 image, a drastic change in land use pattern was seen and water drain coming from survey Nos. 272 and 273 was not seen.

“As per the topographic sheet, Google image, contour map and hydrological map, there is no water channel that connects Mushkin Cheruvu to Nagireddy Kunta, which is on other side of ORR. Based on this data, no obstruction is caused by constructions by My Home DLF Avatar project,” the report pointed out.

There were a couple of streams that flow from Mushkin Cheruvu towards south west and join Narsing lake 2. “It is observed that the developers have not encroached/obstructed/damaged the flow of natural water from Narsingi lake 2, Mushkin Cheruvu to Nagireddy Kunta,” the committee said. Also, they were not located adjacent to the project site and there was no common water channel connecting these three water bodies, it said.

DLF Homes Ltd is the land owner and principal developer of the land and has already obtained an encumbrance certificate (EC). After obtaining the EC, DLF Homes entered into a joint development agreement with My Home Constructions for development of the project.

“DLF continues to be the land owner and joint developer of the project. There is no change of ownership till the project is completed. Hence, an amendment to the EC is not required,” said the committee.

The committed consisted of Rangareddy district collector, a senior official from the ministry of environment and forest, Chennai, and a senior officer from the lake protection committee. The panel inspected the area and submitted a factual report and an action taken report.
