GURUGRAM: After cancelling the occupation certificates (OC) of 41 residential properties for various violations last week, the department of town and country planning (DTCP) on Monday not only cancelled the OC of a residential building in DLF-2 but also sealed the premises and got an FIR registered against its owner.
Acting on a complaint from a local resident, the enforcement team of DTCP visited the site and found unauthorised construction, zoning violations in stilt areas and filling of cutouts in contravention to the OC norms, officials told TOI.
As per norms, the OC of any building stands automatically cancelled if the property owner changes the permitted use of the building or raises any additional construction or alteration in the said building without the approval of the competent authority. Further, if the property owner occupies the portion of the building for which the OC has been granted and violations done later, action will be initiated as per law.
In this case, the building owner has deliberately contravened the provisions of stipulated rules and is continuing with the violation, and therefore the OC was withdrawn and cancelled, the officials said. The property owner has to restore the building failing which the department will take necessary action.
A senior official from the enforcement team said, “During the recent drive, some 41 property owners were found violating the terms and conditions of the sanctions granted to them under the Haryana Development and Regulation of Urban Areas Act 1975, we will recommend filing of FIR against them too.’
“Some property owners had carried out additional construction or altered building structure after obtaining the OC while others were found to be operating commercial activities in residential units.”
