Ardee City's builder booked for violating licence norms, Real Estate News, ET RealEstate
GURUGRAM: The developer of Ardee City, 13 of its associate companies and their directors have been booked for violation of the terms and conditions of the project licence issued by the department of town and country planning (DTCP) for the residential society.

The developer has also been accused of fraudulently showing a portion of land owned by the Haryana Shehri Vikas Pradhikaran (HSVP) as part of the township at the time of seeking the licence.

The move comes after DTCP wrote to the DTCP director seeking action against the developer, Gopal Dass Estates & Housing, on Monday. The builder and its associate companies together had got a licence for the development of its flagship properties — Ardee City and Palm Grove Heights — across 204.4 acres of land in sectors 51-52 and 57. Around 2,850 families are currently living there.

When contacted, Anil Hasija from Gopal Dass Estates said: “We are seeking legal opinion.”

The builder was given three licences in 1995, 1997 and again in 2002 for the projects. But after DTCP received complaints about disputed ownership of around 45.2 acres. As per norms, the developer needs to have the ownership and possession of land before applying for a licence on it.

“The licence was obtained by submitting fake revenue documents. The colony (Ardee City) has not been laid out as per the approved layout plan and a number of other deviations have been observed,” said DTP (enforcement) RS Batth. The title of 45.21 acres of the licensed land is not clear, he added.

According to the DTCP letter written to police on Monday, none of the community sites in the colony have been transferred to the government within the specified time as per terms and conditions of the agreement. “Group housing buildings (blocks A to E) stand occupied without obtaining occupation certificates from the department. None of the documents in compliance with the Haryana Apartment Ownership Act has been submitted till date. None of the EWS plots and flats has been allotted or constructed,” said Batth.

While construction has been carried out on 702 plots, occupation certificates of only 301 buildings have been issued till date. Besides, the developer has not been issued completion or partial completion certificate for the colony so far. DTCP cancelled the licence of Ardee City earlier this month.

A case was registered under Section 10 (violation of licence terms and conditions) of Haryana Development and Regulations of Urban Areas Act and sections 120B (criminal conspiracy), 420 (cheating), 467 (forgery), 468 (forging document) and 471 (using forged document) of the IPC at Sector 53 police station on Monday.

Gopal Dass Estates Housing, Ardee Infrastructure Pvt Ltd, Ardee Business Centre, Ardee Unitron Computers, SAS Leasing, Ardee Mechanical Industries, Neeta Estates Leasing, Ardee Machines, Shivani Verma, Meenakshi Verma, Vishwakarma Housing, Kangaroo Estates and BR Properties have been named as the accused, among others.
